WRONGFUL PRESCRIPTION
When you go to the pharmacy, you assume that a pharmacist, has followed the doctor’s directions and dispensed the prescribed medication pursuant to the doctor’s specifications.
Sadly, there are occasions when the wrong medication and/or wrong dosage is dispensed to a consumer.
If you or a loved one has experienced harmful side effect from a misfilled or mis-dispensed prescription drug you may need the assistance of an attorney to help recover damages on your behalf.
ARE THERE TIME LIMITS FOR FILING A WRONGFUL PRESCRIPTION LAWSUIT IN ALABAMA?
Alabama has a law called a “statute of limitations” which sets a lime limit for filing different kinds of lawsuits.
For Personal Injury matters such as Wrongful Prescription, the time limit in Alabama is two years, meaning you must file a lawsuit against any potential defendant within two years of the date of your accident. (See Ala. Code. Sec. 6-2-38.)
